BIR-continuing monitor tax evader

 

The Bureau of Internal Revenue (BIR) District #51 in Pasay City continues to monitor tax evaders.

Among the steps taken by the BIR-Pasay is the sending of “Notice to Comply” to property and business owners in the city to give them enough time to submit the necessary requirements.

It was learned that the Notice to Comply sent by the BIR dated January 31, 2025 signed by one Mary Ann V. Canare, Revenue District Officer, included Councilor Editha Manguerra and Yok Tin Tan So, both of whom are requesting the agency to issue electronic-Certificate Authorizing Registration (e-CAR) under three OTS Numbers on their deeds of absolute sale which have been assigned to Revenue Officer C. Nofies.

According to the BIR system, Manguerra and So are registered as sole proprietors who engaged in real estate activities under SYT Apartment and VTSO Builders, so the properties sold are considered investments and part of their ordinary assets, so they will initially be covered by the Expanded-Withholding Tax.
The BIR also reminded Manguerra and So to issue a Sales Invoice (SI) to the buyer based on the Gross Selling Price as specified by SEC. 4.106 of Revenue Regulation 16-2005 pursuant to Sections 264- “Failure or Refusal to issue Receipts or Sales or Commercial Invoices, Violations Related to the Printing of such Receipts or Invoices and Other Violations” as amended by the National Internal Revenue Code of 1997.

In this regard, the BIR-Pasay is requiring Manguerra and So to submit the requirements of Sales Invoices to Revenue Officer C. Nofies at 17th Floor, Trium Square, Sen. Gil Puyat Avenue, Pasay City for immediate processing and issuance of their e-CAR.

Meanwhile, the BIR warned that they will only punish establishments that are non-compliant in paying taxes.
It is known that Councilor Manguerra is running for mayor of Pasay while So is a candidate for councilor of District 2 of the city for the May 2025 National and Local Elections.
